For the packages in which we act as a travel organizer, our authorizations are determined by the Act on Providing Services in Tourism, and our General Terms and Conditions are available here.

GENERAL TERMS AND CONDITIONS
These General Terms and Conditions of the travel agency Adriatic Luxury Escapes d.o.o. (the “GTC”) represent a constituent part of the Package Travel Contract (the “Contract”) entered into between the Agency as a travel organizer on one side and the Client on the other side. These GTC apply only to the packages in which the Agency is the organizer, and these GTC do not apply in case that the Agency is acting as an agent and/or selling the services of other tourist agencies. In the latter case, the responsible travel organizer will be indicated in the Contract and the general terms and conditions of that organizer will be applied, which the Agency shall make available to the Client. In case of any discrepancy between the provisions of the Contract and/or the Itinerary and this GTC, the provisions of the Contract i.e. the Itinerary shall prevail. In case of any discrepancy between provisions of the Contract and the Itinerary, the provisions of the Contract shall prevail.

DEFINITIONS AND INTERPRETATION
In addition to the capitalized terms defined elsewhere in the Contract and these GTC, the capitalized terms in the GTC shall have the following meaning:

“Agency” means ADRIATIC LUXURY ESCAPES d.o.o. a travel agency with the seat of office at the address Vladimira Nazora 21, 20000 Dubrovnik, Croatia, registered in the court register of the Commercial Court in Dubrovnik under MBS: 090049594, OIB: 95911801847.

“GDPR” means the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016);

“Client” means the person who wishes to enter into or has entered into the Contract with the Agency for his/her own benefit and/or for the benefit of one or more Travellers;

“Ministry” means the Ministry of the Republic of Croatia competent for tourism;

“Itinerary” means a document which forms a constituent part of the Contract, and which contains pre-contractual information from Article 29 par. 1 items a), b), c), d), e) and f) of the ZPUT;

“Traveller” means every person entitled to travel under the concluded Contract;

“Reasons for which the Agency is not responsible” means the following reasons for which the Agency is exempted from liability for damages to the Traveller: (i) the non-compliance may be attributed to the Traveller; (ii) the non-compliance may be attributed to a third party not related to the provision of travel services covered by the package travel contract and the non-compliance is unforeseeable or unavoidable, or (iii) the non-compliance has occurred due to unavoidable extraordinary circumstances;

“ZPUT” means the Act on the Provision of Tourism Services (Official Gazette 130/2017, 25/2019, 98/2019, 42/2020), as may be amended from time to time.

The definitions in these GTC are applicable to the singular and the plural of such terms. Whenever the words “include,” “includes” or “including” are used in these GTC, they are deemed to be followed by the words “without limitation”. Every reference to the “Contract” shall refer to the Contract as a whole, and not to any particular provision of the Contract. All terms defined in these GTC shall have the defined meaning when used in any certificate or other document made or delivered pursuant to the Contract, unless defined otherwise therein. Legal terms used in these GTC and the Contract shall be interpreted in accordance with the understanding of such terms under Croatian law and not as understood in any other jurisdiction. Unless explicitly provided differently in these GTC, the terms used in these GTC shall have the meaning given to them in the ZPUT.

BOOKING AND CONCLUSION OF CONTRACT
The Client delivers to the Agency the booking inquiry and application in any of the following manners: via the Agency’s website www.adriaticluxuryescapes.com, by telephone, telefax or e-mail.

Upon receipt and processing of the Client’s booking inquiry (which may include further negotiations between the Agency and the Client), the Agency shall deliver to the Client by e-mail the final written proposal of the Contract, the constituent part of which are these GTC and the Itinerary.

To confirm the booking, the Client is required to pay to the Agency the non-refundable advance payment of 30% (thirty-percent) of the total amount that the Client is required to pay to the Agency under the Contract, unless other amount of the advance payment is specified in the Contract. The Client will make a payment of the advance payment on the basis of a written proposal of the Contract delivered by the Agency to the Client, which will specify the deadline by which the advance payment must be paid. The Contract is deemed concluded and enters into force on the day when the Agency has received the full amount of the advance payment specified in the Contract. If the Client does not make payment of the advance payment within the deadline specified in the proposal of the Contract, it will be deemed that the Client has cancelled the booking application and has not accepted the said Contract proposal, and the said Contract proposal is considered invalid by the expiry of that deadline.

The Contract is deemed concluded in the manner set out in this section of the GTC, and shall be valid without the signatures of the Client and/or the Agency. The Client accepts the delivery of the Contract (including these GTC and the Itinerary) in PDF form in the attachment of the Agency’s e-mail as valid delivery on a durable medium, and the Agency shall have no obligation to deliver the Contract to the Client in paper form unless the Client explicitly requests this from the Agency in writing.

The paid advance payment is included in the price of the package. Unless otherwise stated in the Contract, the remainder to the total price of the package has to be paid no later than 45 (forty-five) days before the start of the package, and the exact date of expiry of deadline for the payment of the remaining amount will be specified in the Contract. If the remaining amount of the package price is not paid within the agreed deadline, it is considered that the Client has cancelled the Contract and the Client is required to pay to the Agency the agreed fee for termination of the Contract. Upon completion of all services included in the contracted package, the Agency will issue the final invoice to the Client.

TRANSFER OF THE CONTRACT TO ANOTHER TRAVELLER
Prior to the start of the package, the Client may transfer the Contract to another Traveller who meets all the conditions applicable to that Contract, of which the Client is required to notify the Agency in writing no later than 7 days before the start of the package. The Client and the Traveller to whom the Contract has been transferred are jointly and severally liable to the Agency for the payment of the price, as well as any additional fees, charges or other costs arising from the transfer of the Contract on which the Agency has notified the Client and the Traveller and delivered to them a proof of their occurrence.

MANNER OF PAYMENT
Unless otherwise set out in the Contract, the Client can execute the payment of the Agency’s services in any of the following manners: by payment to the Agency’s IBAN, by credit cards through WSPAY payment gateway online payment. In case of payment to the Agency’s IBAN, all bank fees and costs of the transaction shall be borne by the Client i.e. another Traveller making the payment. The Agency may grant the Client a discount for a certain manner of payment, of which the Agency will inform the Client before initiating payment. All prices of services are stated in EUR. Exceptionally, upon the Client’s explicit written request, the prices of services may be stated in USD in which case the final payment shall be made pursuant to the selling USD/EUR exchange rate of Erste&Steiermärkische Bank d.d., 20000 Dubrovnik, Vukovarska 26 applicable on the payment date. In case of payment by the. The Client is informed that there may be differences between the above-stated applicable exchange rate and the exchange rate in other countries and the Client irrevocably accepts the above-stated applicable exchange rate. Credit/debit card payments cannot be revoked.

PRICE AND CONTENT OF THE PACKAGE
The price of the package is stated in the Contract and includes services which the Agency stated in the Itinerary. Unless otherwise stated in the Itinerary: (i) the price of the package is shown “per person” and is based on “double room accommodation”; (ii) the price of the package includes: transport services and costs, hotel services on the basis of overnight stay with breakfast, other agreed services stated in the Itinerary, tickets for visited sights, services of local guides, and the applicable VAT; (iii) the price of the package does not include: optional trips and excursions, costs of obtaining visas (if any), costs of airplane tickets and airport fees, meals and beverages not stated in the Itinerary, tips to service providers, costs of additional services of hotels or other accommodation units not stated in the Itinerary (such as minibar, laundry service, internet access, etc.).

All types of special services (special dietary requirements, single room accommodation, allergies, health requirements, accommodation in a room or other accommodation unit whose category is higher than the one agreed), must be requested by the Client and agreed with the Agency no later than at the moment of closing the booking and concluding the Contract. If the Client requests such additional services during the trip, and the Agency decides to accept the Client’s request, the Client shall settle the difference in price on site to the Agency’s representative to whom the request was made during the trip or another person designated by the Agency’s representative. For the services payable on site, the Client/Traveller shall file any potential complaints directly to the service provider, and the Agency shall have no responsibility for such services, regardless of the potential help provided to the Client/Traveller in obtaining it. The prices which may be stated in the Itinerary for such additional payments on site are of an informative nature and are subject to change.

The prices stated in the Contract are based on the prices agreed between the Agency and its suppliers and service providers, they do not have to correspond to the prices stated on site in the destination where the Client/Traveller is staying, and the potential differences in prices may not be the subject of complaint of the Client/Traveller. All applicable discounts are stated in the Contract and no other discounts shall be given to the Client or the Travellers. Agency’s costs in the organization of the agreed package represent Agency’s business secret and may not be revealed to the Client. The Agency shall not give any refund to the Client or the Travellers for any service included in the agreed price of the package that the Client/Traveller did not use by his/her decision or fault.

The hotels, apartments and other accommodation objects in the Itinerary are described pursuant to the official categorisation of the respective country at the time of issuance of the Itinerary. The Agency may decide to book accommodation in an object of a higher category than the one agreed, without any surcharge of the Client. Local categorization in particular countries materially differs, the accommodation, meals, comfort and other services are under the supervision of municipal and state tourist administrations, and the standards of accommodation and services vary and are not comparable, which is accepted by the Client and the Traveller, and the Agency has no responsibility for this. The Agency shall have no responsibility for any verbal or written information which is not in line with the description of services and objects in the Itinerary. The placing of the Travellers into particular rooms or apartments in the accommodation object is set by the reception at the destination of stay. Unless the Client has explicitly agreed on a room, apartment or cabin of particular characteristics, the Client shall accept any officially registered accommodation unit in the object described in the Itinerary. Unless the Itinerary states differently, accommodation is not possible before 16:00 on the start date of the service use, and the same must be left by 10:00 on the day of the end of use of the service, and individual arrival into accommodation objects after 20:00 must be notified to the Agency in writing at least 24 hours in advance.

PRICE INCREASE BY THE AGENCY
If the Contract provides the right of the Agency to unilaterally increase the price of package after the conclusion of the Contract, the Agency may unilaterally increase the agreed price no later than 20 days before the start of the package in any of the following cases:

a) change of the price of transport of the Travellers or other power sources resulting from the costs of fuel or other power, but only provided that the Contract explicitly states the amount or portion of the price of the Traveller’s transport in the price of the package;

b) change of the level of taxes or fees on travel services included in the Contract set by third parties which are not directly involved in the performance of the package (including tourist taxes, landing taxes or embarkation or disembarkation fees at ports and air ports), but only provided that the Contract explicitly states the amount or portion of such taxes or fees in the price of the package; or

c) change of the exchange rates applicable on the package, but only provided that the Contract states the amount of services related to the certain currency or their portion in the price of the package.

In case of such unilateral increase of price of the package, the Agency shall unilaterally increase the price for the full amount of the change of the relevant parameter from above items a), b) and/or c), and shall notify the Client in writing with an explanation of the increase and calculation. The Client and the Travellers accept such unilateral increase of the agreed price if it amounts to (and including) 8% of the total agreed price of the package. If the said increase of the price of package exceeds 8% of the total agreed price of the package, the Client may cancel the trip and terminate the Contract without the payment of the Contract termination fee. If the Client does not deliver to the Agency a written Contract termination notice within 2 days as of the receipt of the notice on the price change, it shall be deemed that the Client accepts the price change.

If the Contract provides the right of the Agency to unilaterally increase the price of package after the conclusion of the Contract pursuant to the above stated provisions of these GTC, then the Client shall be entitled under same conditions to deduction of the price corresponding to deduction of the relevant parameters from items a), b) and/or c). In case of such unilateral deduction of the price by the Client, the Agency shall be entitled to deduct the actually incurred administrative costs from the amount of reimbursement due to the Client, and shall, at the Client's request, provide to the Client a proof for these administrative costs.

AMENDMENTS AND TERMINATION OF THE CONTRACT BY THE CLIENT
After the conclusion of the Contract, and prior to the start of package, the Client may unilaterally withdraw from the trip, i.e. unilaterally terminate the Contract by delivery of a written termination notice to the Agency, in which case the Client shall pay to the Agency the following standard Contract termination fee in the amount to be determined according to the date on which the Agency received the Client’s written termination notice, as follows:
Written cancellations received less than 60 days prior to departure are subject to the following loss of travel expenses:
• 59- 46 days before departure 50% of the total price of the package
• 45 or less days before departure, 100% of the package
For the avoidance of doubt, the Agency shall be entitled to charge the Client a termination fee regardless of the reason for which the Client terminates the Contract (including the health conditions of the Client, Travellers and their family members, delays in public transport or other transport arranged by the Client or Traveller, bad weather conditions, etc.) except in case where the Client is entitled to terminate the Contract due to material breach of the Contract by the Agency. In case of any cancellation or shortening of the trip by the Client (including due to bad weather conditions), the above standard termination fees also apply.

As an exception to the preceding provisions, in case of the Client's termination due to unavoidable and extraordinary circumstances which occurred at the destination or in the direct vicinity of the destination and which materially affect the fulfilment of the package or the transport of the Traveller to the destination: (i) the Client is not obliged to pay the above Contract termination fee, (ii) the Client is entitled to the refund of all payments made to the Agency on behalf of the price of the package, (iii) the Client is not entitled to claim any damages. As an exception to the preceding sentence, if the Contract cannot be performed due to unavoidable and extraordinary circumstances, which occurred at the destination or in the direct vicinity of the destination and which materially affect the fulfilment of the package or the transport of the Traveller to the destination, resulting from the special circumstances caused by the COVID-19 epidemic, the provisions of the ZPUT shall apply.

If the Client and/or any Traveller has directly or via the Agency acting as an agent contracted with the insurance company trip cancellation insurance, such insurance is not subject of the Contract and is not included in the amounts to be paid by the Client to the Agency under the Contract. Such Client/Traveller is entitled to a refund of the compensation paid by the insurance company exclusively under the terms of the insurance policy. All terms and deadlines of refund of the funds paid on behalf of the compensation are directly agreed between the insurance company and the Client, and the Agency does not bear any responsibility for any non-recognition or complaint that the insurance company makes to the Client/Traveller at his request for payment under said insurance policy, even if said insurance has been contracted between the Client/Traveller and the insurer via the Agency acting as an agent.

OBLIGATIONS AND RESPONSIBILITIES OF THE AGENCY
The combination of travel services agreed in the Contract represents a package within the meaning of ZPUT, and the Client/Traveller has all the rights arising from ZPUT related to packages. As the trip organizer, the Agency is responsible for the performance of the package as a whole, i.e. for the performance of all services included in the price in the Itinerary. Exceptionally, and only if this is explicitly stated in the Contract, in case of certain trips the Agency may act as an agent, i.e. retailer within the meaning of the provisions of ZPUT, and a third party may act as the trip organizer, in which case: (i) for such packages the Contract shall state the responsible trip organizer, (ii) such trip shall be subject to the general terms and conditions of such third-party responsible organizer, (iii) the Agency shall not be responsible for the performance of tourist arrangements of other organizers, and (iv) by entering into such Contract, the Traveller wholly accepts the itinerary and the terms of the trip of such third-party responsible organizer.

Unless explicitly provided otherwise in the Itinerary, the Agency will provide the contracted services in Croatian and English.

The Agency shall without undue delay provide appropriate assistance to the Traveller in difficulty, in particular by providing appropriate information on health services, local authorities and consular assistance, and by assisting the Traveller to make distance communications and find alternative travel arrangements. If the Traveller has intentionally or negligently caused such difficulty, the Agency may charge the said assistance in the amount of the actual costs which the Agency incurred.

If any of the Travellers is a minor travelling unaccompanied by a parent or other authorised person within a package which includes accommodation, the direct contact with the minor or the person responsible for the minor at the minor's place of residence may be made via the Agency's contact point specified in the Contract.

The Agency shall keep confidential as a business secret all the information about the Client and the Traveller, and shall not without their permission reveal to any person their address, place and time of the trip, stay, paid price or the names of the persons travelling with them, unless this is necessary for the purpose of the performance of the Contract or in the cases prescribed by law.

The Agency excludes any liability of the Agency in case of any of the Reasons for which the Agency is not responsible. For all possible damages for which the Agency would be liable, except for damages resulting from body injury or damage caused by the Agency intentionally or negligently, the maximum amount of damages is limited to three times of the total price of the package. If international conventions binding on the European Union or legal regulations based on them limit the scope of damages to be paid by the travel service provider that is a part of the package or limit the terms under which he is required to compensate such damage, in such case assumptions, limitations and exclusions apply to the Agency in an appropriate manner and the Agency may refer to it in relation to the Client and the Traveller. Damages or reduction of the price to which the Client is entitled to in accordance with these GTC, ZPUT and applicable international conventions and regulations shall be deducted from each other.

OBLIGATIONS AND RESPONSIBILITIES OF THE CLIENT AND THE TRAVELLER
The Client explicitly confirms to the Agency: (i) that the Client has introduced all the Travellers with the Contract (including with the Itinerary and these GTC), (ii) that the Client is authorised to act on behalf of all the Travellers stated in the booking, (iii) that the Client is wholly responsible to the Agency for the compliance of all Travellers with the Contract and is obligated to make all payments provided in the Contract for all Travellers, (iv) that the payments of the advance payment or the total of the price of the package refer to all the Travellers on the same booking, and are distributed equally to all Travellers on that booking, unless provided differently in the Contract.

Whenever these GTC or the Contract provide that the Client gives a statement, guarantee, waiver or undertakes an obligation, it shall be deemed that he does it in his own name and on behalf of each of the Travellers. Whenever these GTC or the Contract provide that the Traveller makes any statement, guarantee, waiver or undertakes any obligation, it shall be deemed that the Traveller does it in his own name and on behalf of the Client.

The Client shall provide all the required personal data of each Traveller and timely deliver to the Agency all documentation required for the organization and the execution of the trip. The Agency may request and keep copies of the documents if this is necessary for the execution of the trip. If the Client does not deliver the requested data and copies of documents in the manner and within the deadline requested by the Agency, it shall be deemed that the Client has cancelled the booking, i.e. terminated the Contract, and the Client shall pay to the Agency the agreed amount of the Contract termination fee. The Client shall be liable for any damages which the Client or any Traveller or the Agency sustains as a result of providing false and/or incomplete data and/or documents.

If any of the Travellers is a minor travelling unaccompanied by a parent or other authorised person within a package which includes accommodation, the Client shall timely deliver to the Agency all consents of the legal representatives of each minor Traveller requested by the Agency pursuant to the Contract and applicable laws (including the consent for the processing of personal data of the minor Traveller).

The Client shall obtain each passport, visa, health insurance card or other travel related documentation required for the travel and stay abroad for each Traveller and shall ensure that the said documentation is at all times complete and valid. The Client is exclusively responsible if any Traveller is unable to take the trip as a result of not having valid travel documents or if the Traveller’s request for the issuance of visa is denied. In case travel documents are stolen or lost during the trip, the Traveller shall solely bear the costs of obtainment of new documents, as well as other costs that may arise in connection with this. Before entering into the Contract, the Client and all Travellers which are not Croatian citizens and do not have Croatian passports must personally inform themselves on the country to which they are travelling and the conditions that they must meet in order to travel to that country, considering the difference of laws applicable for citizens of certain countries. Basic information about the visa regime applicable in the Republic of Croatia is available at the official website of the Croatian Ministry of Foreign and European Affairs http://www.mvep.hr/en/consular-information/visas/visa-requirements-overview/, and the Client may address potential questions related to this to the said Ministry by e-mail at This email address is being protected from spambots. For the avoidance of doubt, the Agency shall have no responsibility for the correctness and completeness of the said information and responses of the Ministry.

The Client is responsible for the checking and confirmation of the dates and times of take-off/landing of flights shown in airplane tickets and for the timely check-in at the airport, and the Agency shall have no liability for the potentially missed flights resulting from late airport check-in.

All Travellers shall respect other people in the country which they are visiting, and at all times comply with all applicable laws (including foreign exchange and customs regulations). The Traveller shall comply with the rules of the accommodation units regarding the time of entering and leaving the rooms, apartments, cabins, etc. If the Traveller breaches the security, peace or comfort of other Travellers or third persons in any way or threatens and/or hinders a regular carrying on of the trip pursuant to the Itinerary, in addition to the right for damages, the Agency is entitled to terminate the trip for the said Traveller and continue the trip pursuant to the Itinerary without that Traveller. If that Traveller is a minor, the Client shall ensure the return of the Traveller home at his/her own cost.

The Traveller shall comply with all reasonable instructions of the Agency’s representative and shall cooperate with the Agency’s representative in good faith. In case of any dissatisfaction, the Traveller shall calmly and in good faith cooperate with the representative of the Agency and shall try to resolve the matter of dissatisfaction on site, without public expression of dissatisfaction, influence on other Travellers and third persons, and any actions which might harm the Agency’s reputation.

Before concluding the Contract, the Client shall notify the Agency on all facts related to the health, habits, etc. of each Traveller which could endanger the trip (including the fact that the Traveller due to health or other reasons requests particular types of food, has chronic illnesses, allergies, etc.). If the Itinerary provides special travel rules (such as, for example, mandatory vaccination and obtainment of certain documents), the Traveller shall comply with such rules.

The Client explicitly represents that the Client and all Travellers shall refrain from any public statements or publications on the Internet or in any other media which would in whole or in part be false, incomplete or misleading and might harm the reputation and interests of the Agency. Such actions shall result in the Client’s obligation to compensate all damages which the Agency may sustain (including all lost profits and infringement of personal rights), and may also have the attributes of a criminal act pursuant to applicable laws.

The Traveller shall keep the privacy of all other Travellers and third persons, and shall not in any way record, photograph or keep their personal data contrary to the GDPR. The Traveller explicitly states that he/she is informed about the fact that the penalties for the breach of the GDPR are significant, and shall be liable to the Agency for the full amount of the penalties and other damages which the Agency might sustain as a result of the breach of the GDPR by the Traveller.

In case of breach of the obligation from the Contract and applicable laws, the Client and the Traveller shall be liable for any damage sustained by any Traveller, the Agency, any service provider included in the package or any third person, and shall indemnify the Agency against all claims on that ground. The Client is jointly and severally liable with the Traveller for the obligations of the Traveller from the preceding sentence. In case of breach of the obligation from the preceding sentence which results in the termination of the trip, the Agency shall have no further liability towards the Client/Traveller (including the organization of the return to his/her domicile country), and the Agency shall not refund any paid amounts, and shall not bear any costs or damages resulting from the termination of the trip.

COMPLAINTS
The Client and/or the Traveller shall without undue delay and taking into account the circumstances, notify the Agency via the contact point of the Agency specified in the Contract of any non-compliance found during the performance of the travel service covered by the Contract. At the request of the Client or the Traveller, the Agency shall correct such non-compliance, unless this is not possible or if the elimination of the non-compliance would cause disproportionate costs taking into account the extent of non-compliance and the value of travel services affected by the non-compliance. If the Agency does not remedy the non-compliance for the reasons stated in the preceding sentence, the Client is entitled to a price deduction, and in addition to that, to compensation unless the same is the consequence of the Reasons for which the Agency is not responsible. If the Agency, upon the complaint of the Client or the Traveller, eliminates the observed non-compliance, and the Traveller accepts and uses such service, the Traveller waives any further complaints, rights and claims on these grounds.

If the non-compliance is not resolved pursuant to the preceding section of these GTC, the Client may file to the Agency a written complaint personally at the office of the Agency, by e-mail at This email address is being protected from spambots. You need JavaScript enabled to view it., by telefax or by registered mail at the address of the Agency specified in these GTC. The Client must file the said complaint to the Agency at the latest within 8 days as of the end of the trip and must enclose to it the evidence that the Client/Traveller had acted pursuant to the preceding section of these GTC. If the Client failed to file the said complaint to the Agency within the deadline from the preceding sentence or failed to enclose to it the evidence that the Client/Traveller had acted pursuant to the preceding section of these GTC, it shall be deemed that the Client has waived all the rights and claims of the Client or any Traveller on these grounds, and in such case the Client and all Travellers shall permanently refrain from any negative comments and other actions which may harm the reputation and interests of the Agency. The Agency shall deliver to the Client the written response – decision on the complaint, within 15 days as of the receipt of the Client’s complaint. Until the expiry of the said deadline, the Client waives the right to initiate any court, arbitration, administrative or any other proceedings, as well as to make any statements or announcements in the media or via the Internet. The maximum amount of price deduction upon the Client’s complaint is the amount of the disputed part of the services, and may not include the services already used or the total amount of the price of the package.

TRAVEL INSURANCE
We recommend and request when concluding a Contract/Voucher with the Client that the Client and all of the Client's companions have adequate and sufficient travel insurance to cover the Trip, as neither Adriatic Luxury Escapes d.o.o. nor our suppliers can be held responsible for any liability, costs or losses incurred due to inadequate insurance . We recommend that at the time of booking the trip, the Client obtains a comprehensive travel insurance policy.

CHANGES OF THE ITINERARY AND CANCELLATION OF THE TRIP BY THE AGENCY
After concluding the Agreement, and before the start of the package, the Agency may unilaterally change the terms of the Contract by delivering a written notice to the Client, provided that such change is insignificant, i.e. that it does not significantly change any of the main features of travel services, does not reduce the level of quality or value of the package, or does not cause significant inconvenience or additional costs for the Traveller. If the Agency is forced to significantly change any of the main features of travel services after concluding the Contract and before the start of the package, or is unable to meet the contracted special requirements of the Traveller specified in the Contract, it must notify the Client in writing without any delay. The said notice will include a description of the proposed changes to the Contract and potential replacement package that the Agency may offer to the Client. Unless otherwise specified in such written notice of the Agency, if within 3 days of receipt of the said notice of the Agency the Client does not notify the Agency in writing that he accepts the amended Contract or offered replacement package, the Contract shall be deemed to be terminated and the Agency shall without delay and no later than within 14 days, return to the Client/Travellers the part of the price paid so far. If the changes to the Contract result in a package deal of lower quality or price, the Client is entitled to an appropriate price reduction.

The Agency may terminate the Contract and fully refund to the Client/Travellers all payments received for the package, without any obligation to compensate damages and any other payments to the Client or any of the Travellers, in case the Agency is prevented in the performance of the Contract by unavoidable and extraordinary circumstances provided that the Agency notifies the Client on Contract termination without undue delay before the start of the package.

INSURANCE OF DEPOSIT IN CASE OF INSOLVENCY AND LIABILITY FOR DAMAGES INSURANCE
Pursuant to ZPUT, the Agency entered into the Insurance Agreement on 11.11.2024 with the insurance company EUROHERC osiguranje d.d. ZAGREB|OIB 22694857747|Podružnica DUBROVNIK, Dr. Ante Starčevića , which provides deposit insurance in case of insolvency enabling the Traveller to achieve rights from the deposit directly from the insurance company, under the insurance policy number 804474853. In case of occurrence of the insured event the Client/Traveller must in the most expeditious manner contact the said insurance company EUROHERC osiguranje d.d. Pursuant to ZPUT, the Agency entered into the Insurance Agreement on 11.11.2024 with the insurance company EUROHERC osiguranje d.d. This is valid as a confirmation on the insurance in case of bankruptcy or the Agency’s inability to pay and on damage liability.

PERSONAL DATA PROTECTION
The Client and the Travellers provide personal data to the Agency voluntarily. Personal data of the Client and the Traveller is needed in the process of realization of the contracted package and will be used for further communication, contracting and the performance of services included in the package. The Agency shall process, use and keep personal data of the Client and the Traveller in compliance with applicable laws, including GDPR, and shall not export it out of the country or provide it to third persons, except to suppliers and partners participating in the realization of the contracted package. Personal data of the Client and the Travellers shall be kept in the database, pursuant to the decision of the Agency on the manner of collecting, processing and keeping personal data. Provided that the Client/Traveller has given his/her consent to do so, the Agency may use the personal data of the Client/Traveller for marketing purposes (e.g. sending of information, promotions, newsletters). The Client and every Traveller may at any time withdraw their consent for the use of personal data for marketing purposes by sending an e-mail request to the Agency at This email address is being protected from spambots. By concluding the Contract, the Client confirms that he has read the said policy, that the Client has informed all Travellers about them, and that the Client and the Travellers fully understand and accept the said policy.

FINAL PROVISIONS
The delivery of a notice between the Parties in accordance with the Contract shall be deemed to have been validly made in writing if it is sent by e-mail to the last e-mail address notified by one Party to the other in writing. The Client is solely responsible for the accuracy of the e-mail address for sending the notification of which the Client has notified the Agency, and is obliged to notify the Agency in writing without delay of any change in the data for sending the notification.

The Parties shall try to resolve all potential disputes related to the Contract (including its performance and termination) amicably, and if this is not possible, the competent court shall be in Dubrovnik, Croatia. The governing law shall be Croatian law (excluding its provisions on conflict of laws that would refer to the application of foreign law). Pursuant to ZPUT, the Client may submit a request for resolving the dispute before the body from the list of notified bodies for alternative resolution of consumer disputes, pursuant to the provisions of a special act governing alternative resolution of consumer disputes. Should any provision of Contract or these GTC be or become invalid or unenforceable, or should the Contract contain an unintended contractual gap, then the validity or enforceability of the remainder of the Contract shall not be affected. Any such invalid or unenforceable provision shall be deemed replaced by, or any gap deemed to be filled with, an appropriate provision, which, in accordance with the economic purpose and object of that provision and/or Contract, and as far as legally permissible, shall come closest to the Parties’ original intention.

These GTC exclude any previously issued general terms and conditions of the Agency on package travel and shall enter into force on the date of its publication on the Agency's website, i.e. on November 11th, 2024 The Agency reserves the right to change these GTC at any time by publishing the amended text of the GTC on the Agency's website, which enters into force on the day of publication.

Key rights of the traveller pursuant the Act on Providing Services in Tourism
Travellers will receive all essential information about the package before concluding the package travel contract.
There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the travel agent.
Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
The price of the package may only be increased if specific costs rise (for instance, fuel prices) and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8 % of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.
Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate.
Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
The organiser has to provide assistance if the traveller is in difficulty.
If the organiser or, in some Member States, the retailer becomes insolvent, payments will be refunded. If the organiser or, where applicable, the retailer becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured. OPĆE ODREDBE
Ovi Opći uvjeti poslovanja putničke agencije Adriatic Luxury Escapes d.o.o. („Opći uvjeti“) sastavni su dio Ugovora o putovanju u paket-aranžmanu („Ugovor“) sklopljenog između Agencije kao organizatora putovanja s jedne strane i Klijenta s druge strane. Ovi Opći uvjeti vrijede samo za paket-aranžmane u kojima je Agencija organizator, te se isti ne primjenjuju u slučaju da Agencija posreduje i/ili prodaje usluge drugih turističkih agencija. U potonjem slučaju u Ugovoru će biti naznačen odgovorni organizator putovanja te će se primjenjivati opći uvjeti tog organizatora koje će Agencija učiniti dostupnima Klijentu. U slučaju bilo kakvog neslaganja odredbi Ugovora i/ili Programa putovanja s ovim Općim uvjetima, odredbe Ugovora odnosno Programa putovanja će prevladati. U slučaju bilo kakvog neslaganja odredbi Ugovora s Programom putovanja, odredbe Ugovora će prevladati.

DEFINICIJE I TUMAČENJE
Uz pojmove označene velikim slovom koji su definirani na drugim mjestima u Ugovoru i ovim Općim uvjetima, pojmovi označeni velikim slovom u Općim uvjetima imaju sljedeće značenje:

„Agencija“ označava ADRIATIC LUXURY ESCAPES d.o.o. za turizam i usluge, turistička agencija sa sjedištem na adresi Vladimira Nazora 21, 20000 Dubrovnik, Hrvatska, upisanu u sudskom registru Trgovačkog suda u Dubrovniku pod MBS: 090049594, OIB: 95911801847;

„GDPR“ označava Opću uredbu o zaštiti podataka (Uredba (EU) 2016/679 Europskog parlamenta i Vijeća od 27. travnja 2016.);

„Klijent“ označava osobu koja želi sklopiti ili je sklopila Ugovor s Agencijom u svoju korist i/ili u korist jednog ili više Putnika;

„Ministarstvo“ označava Ministarstvo Republike Hrvatske nadležno za turizam;

„Program putovanja“ označava dokument koji čini sastavni dio Ugovora, a koji sadrži predugovorne informacije iz članka 29. st. 1. točke a), b), c), d), e) i f) ZPUT-a;

„Putnik“ označava svaku osobu koja ima pravo putovati na temelju sklopljenog Ugovora;

„Razlozi za koje Agencija ne odgovara“ označava sljedeće razloge zbog kojih se Agencija oslobađa odgovornosti za štetu prema Putniku: (i) nesukladnost se može pripisati Putniku; (ii) nesukladnost se može pripisati trećoj osobi koja nije povezana s pružanjem usluga putovanja obuhvaćenih ugovorom o putovanju u paket-aranžmanu i da je nesukladnost nepredvidiva ili neizbježna, ili (iii) do nesukladnosti je došlo zbog izvanrednih okolnosti koje se nisu mogle izbjeći;

„ZPUT“ označava Zakon o pružanju usluga u turizmu (Narodne novine broj 130/2017, 25/2019, 98/2019, 42/2020), sa svim njegovim kasnijim eventualnim izmjenama, dopunama i/ili zamjenama.

Definicije sadržane u ovim Općim uvjetima primjenjuju se na oblike u jednini kao i u množini tih izraza. Kada god se riječi “uključuju”, “uključuje” ili “uključujući” koriste u ovim Općim uvjetima, smatra se da iza njih slijede riječi “bez ograničenja”. Svaka referenca na „Ugovor“ odnosi se na Ugovor kao cjelinu, a ne na bilo koju posebnu odredbu Ugovora. Svi izrazi definirani u ovim Općim uvjetima imaju definirano značenje kada se koriste u bilo kojoj potvrdi ili drugoj ispravi koja je sačinjena ili predana prema Ugovoru, osim ako su tamo drugačije definirani. Pravni termini korišteni u ovim Općim uvjetima i Ugovoru će biti tumačeni u skladu s razumijevanjem navedenih termina prema hrvatskom pravu a ne prema razumijevanju u bilo kojoj drugoj jurisdikciji. Izrazi korišteni u ovim Općim uvjetima imaju značenje utvrđeno ZPUT-om, osim ako ovim Općim uvjetima nije izričito određeno drugačije.

REZERVACIJA I SKLAPANJE UGOVORA
Klijent dostavlja Agenciji upit i prijavu za rezervaciju paket-aranžmana na jedan od sljedećih načina: putem mrežne stranice Agencije www.adriaticluxuryescapes.com, telefonom, telefaksom ili elektronskom poštom.
Po zaprimanju i obradi Klijentovog upita za rezervaciju (koja obrada može uključivati i daljnje pregovore između Agencije i Klijenta), Agencija e-mailom dostavlja Klijentu konačni pisani prijedlog Ugovora čiji sastavni dio su ovi Opći uvjeti i Program putovanja.
Za potvrdu rezervacije Klijent je dužan podmiriti Agenciji predujam (akontaciju) od 30% (trideset-posto) bez mogućnosti povrata novca ukupnog iznosa koji je Klijent dužan platiti Agenciji prema Ugovoru, ako drugačiji iznos predujma nije naveden u Ugovoru. Klijent će uplatu predujma izvršiti na temelju pisanog prijedloga Ugovora koji je Agencija dostavila Klijentu u kojem će biti naveden i rok do kada predujam mora biti plaćen. Ugovor se smatra sklopljenim i stupa na snagu s danom kada je Agencija zaprimila cjelokupni iznos predujma navedenog u Ugovoru. Ako Klijent ne izvrši uplatu predujma u roku navedenom u prijedlogu Ugovora, smatrat će se da je Klijent otkazao prijavu za rezervaciju, te da nije prihvatio navedeni prijedlog Ugovora, a navedeni prijedlog Ugovora se protekom tog roka smatra nevažećim.

Ugovor se smatra sklopljenim na način opisan u ovom odjeljku Općih uvjeta, te je valjan i bez potpisa Klijenta i/ili Agencije. Klijent prihvaća dostavu Ugovora (uključujući i ove Opće uvjete i Program putovanja) u PDF obliku u privitku e-maila Agencije kao valjanu dostavu na trajnom nosaču podataka, te Agencija neće biti dužna dostavljati Klijentu Ugovor u papirnatom obliku osim ako to Klijent izričito zatraži od Agencije pisanim putem.

Uplaćeni predujam uračunava se u cijenu paket-aranžmana. Ako u Ugovoru nije drukčije navedeno, ostatak do ukupne cijene paket-aranžmana uplaćuje se najkasnije 45 (četrdesetpet) dana prije početka paket-aranžmana, te će točan dan isteka roka za uplatu preostalog iznosa biti naveden u Ugovoru. Ako preostali iznos cijene paket-aranžmana ne bude uplaćen u ugovorenom roku, smatra se da je Klijent otkazao Ugovor te je Klijent dužan platiti Agenciji ugovorenu naknadu za raskid Ugovora. Po završetku svih usluga uključenih u ugovoreni paket-aranžman, Agencija će izdati Klijentu konačnu fakturu.

PRIJENOS UGOVORA NA DRUGOG PUTNIKA
Prije početka paket-aranžmana Klijent može prenijeti Ugovor na drugog Putnika koji ispunjava sve uvjete koji se primjenjuju na taj Ugovor o čemu je dužan obavijestiti Agenciju pisanim putem najkasnije 7 dana prije početka paket-aranžmana. Klijent i Putnik na kojeg je prenesen Ugovor solidarno su odgovorni Agenciji za plaćanje iznosa cijene, te pored toga i svih eventualnih dodatnih naknada, pristojbi ili ostalih troškova koji proizlaze iz prijenosa Ugovora o kojima ih je Agencija obavijestila te im dostavila dokaz o njihovom nastanku.

NAČIN PLAĆANJA
Osim ako je drugačije predviđeno Ugovorom, Klijent plaćanje usluga Agencije može izvršiti na bilo koji od sljedećih načina: uplatom na IBAN Agencije i online plaćanjem debitnim i kreditnim karticama.
Monri WSPay je siguran sustav za online plaćanje, plaćanje u realnom vremenu, kreditnim i debitnim karticama te drugim načinima plaćanja. Monri WSPay kupcu i trgovcu osiguravaju siguran upis i prijenos upisanih podataka o karticama što podvrđuje i PCI DSS certifikat koji Monri WSPay ima. Monri WSPay koristi SSL certifikat 256 bitne enkripcije te TLS 1.2 kriptografski protokol kao najviše stupnjeve zaštite kod upisa i prijenosa podataka.korištenjem. U slučaju plaćanja na IBAN Agencije, sve bankovne naknade i troškove transakcije plaća Klijent odnosno drugi Putnik koji vrši uplatu. Agencija može odobriti Klijentu popust za određeni način plaćanja, o čemu će Agencija obavijestiti Klijenta prije iniciranja plaćanja. Sve cijene usluga su navedene u EUR. Iznimno, na izričit pisani zahtjev Klijenta, cijene usluga mogu se izraziti u USD u kojem slučaju se na konačno plaćanje primjenjuje prodajni USD/EUR tečaj Erste&Steiermärkische Bank d.d., Poduzetnički centar Split - PJ Dubrovnik, 20000 Dubrovnik, Vukovarska 26 važeći na dan plaćanja. Klijent je upoznat da mogu postojati razlike između gore navedenog primjenjivog tečaja i tečaja u drugim zemljama, te Klijent neopozivo prihvaća gore navedeni primjenjiv tečaj. Plaćanje izvršeno kreditnom/debitnom karticom ne može se opozvati.

CIJENA I SADRŽAJ PAKET-ARANŽMANA
Cijena paket-aranžmana navedena je u Ugovoru te uključuje usluge koje je Agencija navela u Programu putovanja. Osim ako je drugačije navedeno u Programu putovanja: (i) cijena paket-aranžmana prikazuje se „po osobi“ i temeljena je na „smještaju u dvokrevetnoj sobi“; (ii) cijena paket-aranžmana uključuje: usluge i troškove prijevoza, hotelske usluge na bazi noćenja s doručkom, ostale dogovorene usluge navedene u Programu putovanja, ulaznice za posjećene objekte, usluge lokalnih vodiča, te pripadajući PDV; (iii) cijena paket-aranžmana ne uključuje: opcionalne izlete i ekskurzije, troškove pribavljanja viza (ako ih ima), troškove zrakoplovnih karata i naknada zračnih luka, obroke i pića koja nisu navedena u Programu putovanja, napojnice pružateljima usluga, troškove dodatnih usluga hotela ili drugih smještajnih jedinica koji nisu navedeni u Programu putovanja (poput troškova mini bara, usluga pranja rublja, pristupa internetu i sl.).

Sve vrste posebnih usluga (posebne prehrambene potrebe, smještaj u jednokrevetnoj sobi, alergije, zdravstvene potrebe, boravak u sobi ili drugoj smještajnoj jedinici više kategorije od dogovorene), Klijent mora zatražiti i dogovoriti s Agencijom najkasnije prilikom zaključivanja rezervacije i Ugovora. Ako Klijent zatraži takve dodatne usluge tijekom putovanja, a Agencija odluči iste prihvatiti, Klijent se obvezuje podmiriti razliku u cijeni na licu mjesta predstavniku Agencije, kojem je zahtjev podnesen tijekom putovanja i boravka ili drugoj osobi po uputi predstavnika Agencije. Za usluge koje se plaćaju na licu mjesta Klijent/Putnik eventualni prigovor podnosi izravno izvršitelju usluge, te Agencija ne snosi odgovornost za tu uslugu, bez obzira na eventualnu pomoć Klijentu/Putniku u pribavljanju iste. Cijene koje su eventualno navedene u Programu putovanja za takve doplate na licu mjesta informativnog su karaktera i podložne promjeni.

Cijene navedene u Ugovoru su temeljene na cijenama ugovorenima između Agencije i njenih dobavljača i pružatelja usluga, iste ne moraju odgovarati cijenama navedenim na licu mjesta na odredištu na kojem boravi Klijent/Putnik, te eventualne razlike u cijenama ne mogu biti predmet prigovora Klijenta/Putnika. Svi primjenjivi popusti navedeni su u Ugovoru te nikakvi drugi popusti neće biti odobreni Klijentu niti Putnicima. Troškovi koje Agencija ima u organizaciji ugovorenog paket-aranžmana predstavljaju poslovnu tajnu Agencije te ne mogu biti otkriveni Klijentu. Agencija ne odobrava povrat sredstava Klijentu ni Putnicima za bilo koju uslugu uključenu u ugovorenu cijenu paket-aranžmana koju Klijent/Putnik nije iskoristio svojom odlukom ili krivnjom.

Hoteli, apartmani ili drugi smještajni objekti u Programu putovanja opisani su prema službenoj kategorizaciji dotične zemlje u trenutku izdavanja Programa putovanja. Agencija može odlučiti rezervirati smještaj u smještajnom objektu više kategorije od dogovorene, bez ikakve dodatne nadoplate Klijenta. Lokalna kategorizacija u pojedinim zemljama bitno se razlikuje, smještaj, prehrana, udobnost i druge usluge pod nadzorom su mjesnih i državnih turističkih uprava, a standardi smještaja i usluga su različiti i nisu usporedivi, što Klijent i Putnik prihvaćaju te Agencija ne preuzima nikakvu odgovornost za navedeno. Agencija ne preuzima odgovornost za bilo koju usmenu ili pisanu informaciju koja nije u skladu s opisom usluga i objekata u Programu putovanja. Raspored smještaja Putnika u sobama ili apartmanima u smještajnom objektu određuje recepcija u mjestu boravka. Ako Klijent nije izričito ugovorio sobu, apartman ili kabinu posebnih odlika, prihvatit će bilo koju službeno registriranu smještajnu jedinicu za izdavanje u objektu opisanom u Programu putovanja. Ako u Programu putovanja nije navedeno drugačije, smještaj nije moguć prije 16 sati na dan početka korištenja usluge, a isti se mora napustiti do 10 sati na dan završetka korištenja usluge, a individualni dolazak u smještajne objekte iza 20 sati mora se najaviti Agenciji najmanje 24 sata unaprijed pisanim putem.

POVEĆANJE CIJENE OD STRANE AGENCIJE
Ako je Ugovorom predviđeno pravo Agencije da jednostrano poveća cijenu paket-aranžmana nakon sklapanja Ugovora, tada Agencija smije jednostrano povećati ugovorenu cijenu najkasnije 20 dana prije početka paket-aranžmana u bilo kojem od sljedećih slučajeva:

a) promjene cijene prijevoza Putnika koje su proizašle iz troškova goriva ili drugih izvora energije, ali samo pod uvjetom da je u Ugovoru izričito naveden iznos ili udio cijene prijevoza Putnika u cijeni paket-aranžmana;

b) promjene visine poreza ili naknada za usluge putovanja obuhvaćene Ugovorom koje određuju treće osobe koje nisu izravno uključene u izvršenje paket-aranžmana (uključujući turističke poreze, pristojbe za slijetanje ili naknade za ukrcaj ili iskrcaj u lukama i zračnim lukama), ali samo pod uvjetom da je u Ugovoru izričito naveden iznos ili udio takvih poreza ili naknada u cijeni paket-aranžmana; ili

c) promjene deviznih tečajeva koji su primjenjivi na paket-aranžman, ali samo pod uvjetom da je u Ugovoru naveden iznos usluga vezanih za određenu valutu ili njihov udio u cijeni paket-aranžmana.

U slučaju ovakvog jednostranog povećanja cijene paket-aranžmana, Agencija će jednostrano uvećati cijenu za cjelokupni iznos promjene odgovarajućeg parametra iz gornjih točaka a), b) i/ili c), te će o tome obavijestiti Klijenta u pisanom obliku uz obrazloženje povećanja i izračun. Klijent i Putnici prihvaćaju takvo jednostrano povećanje ugovorene cijene ako isto iznosi do (i uključujući) 8% ugovorene ukupne cijene paket-aranžmana. Ako navedeno povećanje cijene paket-aranžmana prelazi 8% ugovorene ukupne cijene paket-aranžmana, Klijent ima pravo otkazati putovanje odnosno raskinuti Ugovor bez plaćanja naknade za raskid Ugovora. Ako Klijent u roku od 2 dana od pisane obavijesti Agencije o promjeni cijene ne dostavi Agenciji pisanu obavijest o raskidu Ugovora, smatra se da je suglasan s promjenom cijene.

Ako je Ugovorom predviđeno pravo Agencije da jednostrano poveća cijenu paket-aranžmana nakon sklapanja Ugovora u skladu s gornjim odredbama ovih Općih uvjeta, tada Klijent pod istim uvjetima ima pravo na sniženje cijene koje odgovara sniženju odgovarajućih parametara iz točke a), b) i/ili c). U slučaju ovakvog jednostranog sniženja cijene od strane Klijenta, Agencija ima pravo od iznosa povrata koji duguje Klijentu oduzeti stvarno nastale administrativne troškove te će na zahtjev Klijenta dati Klijentu dokaze za te administrativne troškove.

IZMJENE I RASKID UGOVORA OD STRANE KLIJENTA
Nakon sklapanja Ugovora, a prije početka paket-aranžmana, Klijent može jednostrano odustati od putovanja, odnosno jednostrano raskinuti Ugovor dostavom Agenciji pisane obavijesti o raskidu, u kojem slučaju je Klijent dužan platiti Agenciji sljedeću standardnu naknadu za raskid Ugovora u visini koja se određuje ovisno o datumu s kojim je Agencija zaprimila pisanu obavijest Klijenta o raskidu, kako slijedi:
Pisana otkazivanja primljena manje od 60 dana prije polaska podliježu sljedećem gubitku troškova putovanja:
• 59- 46 dana prije polaska 50% ukupne cijene putovanja
• 45 ili manje dana prije polaska, 100% cijene putovanja
Radi izbjegavanja dvojbe, Agencija ima pravo naplatiti od Klijenta naknadu za raskid Ugovora neovisno o razlogu zbog kojeg Klijent raskida Ugovor (uključujući zdravstveno stanje Klijenta, Putnika i članova njihovih obitelji, kašnjenja javnog prijevoza ili drugog prijevoza kojeg je ugovorio sam Klijent ili Putnik, loših vremenskih uvjeta, itd.) osim u slučaju kada Klijent ima pravo na raskid Ugovora zbog povreda Ugovora od strane Agencije. U slučaju bilo kakvog otkaza ili skraćenja putovanja od strane Klijenta (uključujući i zbog loših vremenskih uvjeta), također se primjenjuju gore navedene standardne naknade za raskid Ugovora.
Imajte na umu: određeni putni aranžmani se ne mogu mijenjati nakon što su potvrđeni. Sve usluge bez mogućnosti povrata novca bit će navedene u našoj ponudi prije rezervacije i mogu izazvati troškove otkazivanja do 100% ukupne cijene plana putovanja.
Iznimno od prethodnih odredbi, u slučaju Klijentovog raskida uslijed izvanrednih okolnosti koje se nisu mogle izbjeći, a koje su nastupile na odredištu ili u njegovoj neposrednoj blizini i koje znatno utječu na ispunjenje paket-aranžmana ili koje znatno utječu na prijevoz Putnika na odredište: (i) Klijent nije dužan platiti gore navedenu standardnu naknadu za raskid Ugovora, (ii) Klijent ima pravo na povrat svih izvršenih plaćanja Agenciji na ime cijene paket-aranžmana, (iii) Klijent nema pravo na nikakvu naknadu štete. Iznimno od prethodne rečenice, ako se Ugovor ne može izvršiti zbog izvanrednih okolnosti koje se nisu mogle izbjeći, a koje su nastupile na odredištu ili u njegovoj neposrednoj blizini i koje znatno utječu na ispunjenje paket-aranžmana ili koje znatno utječu na prijevoz Putnika na odredište, a koje su posljedica posebnih okolnosti uzrokovanih epidemijom bolesti COVID-19, primijenit će se odredbe ZPUT-a.

Ako je Klijent i/ili bilo koji Putnik izravno ili preko Agencije kao posrednika ugovorio s osiguravajućim društvom osiguranje od otkaza putovanja, takvo osiguranje nije predmet Ugovora i nije uključeno u iznose koje Klijent treba platiti Agenciji prema Ugovoru. Takav Klijent/Putnik ima pravo na povrat uplaćenih sredstava naknade od osiguravajućeg društva isključivo prema uvjetima police osiguranja. Svi uvjeti i rokovi povrata uplaćenih sredstava na ime naknade izravno su ugovoreni između osiguravajućeg društva i Klijenta, te Agencija ne snosi nikakvu odgovornost za bilo kakvo nepriznavanje ili prigovor koji osiguravajuće društvo uputi Klijentu/Putniku na njegov zahtjev za isplatu po navedenoj polici osiguranja, čak i ako je navedeno osiguranje Klijent/Putnik ugovorio s osiguravateljem putem Agencije kao posrednika.

OBVEZE I ODGOVORNOSTI AGENCIJE
Kombinacija usluga putovanja koja je ugovorena Ugovorom predstavlja paket-aranžman u smislu ZPUT-a, te Klijent/Putnik ima sva prava koja proizlaze iz odredbi ZPUT-a koja se odnose na paket-aranžmane. Agencija je kao organizator putovanja odgovorna za izvršenje paket-aranžmana kao cjeline, to jest za izvršenje svih usluga koje su uključene u cijenu u Programu putovanja. Iznimno, i samo ako je to izričito navedeno u Ugovoru, kod pojedinih putovanja Agencija može nastupati kao posrednik, odnosno prodavatelj u smislu odredaba ZPUT-a, a treća osoba može nastupati kao organizator putovanja, u kojem slučaju: (i) će za takve paket aranžmane u Ugovoru biti naznačen odgovorni organizator putovanja, (ii) se na to putovanje primjenjuju opći uvjeti tog trećeg odgovornog organizatora, (iii) Agencija ne odgovara za provedbu turističkih aranžmana drugih organizatora, te (iv) sklapanjem Ugovora Putnik u cijelosti prihvaća program i uvjete putovanja tog trećeg odgovornog organizatora.

Ako u Programu putovanja nije izričito predviđeno drugačije, Agencija će ugovorene usluge pružiti na hrvatskom i engleskom jeziku.

Agencija će bez nepotrebnog odgađanja Putniku u poteškoćama pružiti primjerenu pomoć, posebice pružanjem primjerenih informacija o zdravstvenim službama, lokalnim tijelima i konzularnoj pomoći i pomaganjem Putniku pri uspostavljanju daljinske komunikacije i pri pronalaženju alternativnih putnih aranžmana. Ako je Putnik takvu poteškoću prouzročio namjerno ili nepažnjom, Agencija može naplatiti navedenu pomoć u visini svojih stvarnih troškova.

Ako je neki od Putnika maloljetnik koji putuje bez pratnje roditelja ili druge ovlaštene osobe u okviru paket-aranžmana koji uključuje smještaj, izravan kontakt s maloljetnikom ili osobom odgovornom za maloljetnika u mjestu boravka maloljetnika moguće je ostvariti putem kontaktne točke Agencije navedene u Ugovoru.

Agencija je dužna čuvati, kao poslovnu tajnu, sve što je saznala o Klijentu i Putniku te bez njihova odobrenja, osim u zakonom propisanim slučajevima i ako je potrebno za potrebe izvršenja Ugovora, nikome ne smije priopćiti: njihovu adresu, mjesto i vrijeme putovanja, boravka, uplaćenu cijenu, kao ni imena njihovih suputnika.

Agencija isključuje svaku odgovornost u slučaju postojanja bilo kojeg od Razloga za koje Agencija ne odgovara. Za sve eventualne štete za koje bi Agencija bila odgovorna, osim šteta koje su posljedica tjelesne ozljede ili šteta koje je Agencija prouzročila namjerno ili nepažnjom, maksimalni iznos štete ograničen je na trostruku ukupnu cijenu paket-aranžmana. Ako se međunarodnim konvencijama koje obvezuju Europsku uniju ili zakonskim propisima koji se temelje na njima ograničuje opseg naknade štete koju je dužan platiti pružatelj usluge putovanja koja je dio paket-aranžmana ili ograničuju uvjeti pod kojima je on dužan tu štetu nadoknaditi, u tom slučaju iste se pretpostavke, ograničenja i isključenja na odgovarajući način primjenjuju na Agenciju te se Agencija u odnosu na Klijenta i Putnika može pozvati na to. Naknada štete ili sniženje cijene na koje Klijet ima pravo u skladu s ovim Općim uvjetima, ZPUT-om te primjenjivim međunarodnim konvencijama i uredbama oduzimaju se jedna od drugih.

OBVEZE I ODGOVORNOSTI KLIJENTA I PUTNIKA
Klijent izričito potvrđuje Agenciji: (i) da je sve Putnike upoznao s Ugovorom (uključujući i Programom putovanja i ovim Općim uvjetima), (ii) da je ovlašten djelovati u ime svih Putnika navedenih u rezervaciji, (iii) da je u cijelosti odgovoran Agenciji za poštivanje Ugovora od strane svih Putnika te je dužan izvršiti sva plaćanja predviđena Ugovorom za sve Putnike, (iv) da se uplate predujma odnosno cjelokupne cijene paket-aranžmana odnose na sve Putnike na istoj rezervaciji, te se raspoređuju jednako na sve Putnike na toj rezervaciji ako nije drukčije predviđeno Ugovorom.

Kada god je ovim Općim uvjetima ili Ugovorom predviđeno da Klijent daje neku izjavu, jamstvo, odricanje ili preuzima neku obvezu, smatra se da isto čini u svoje ime i u ime svakog od Putnika. Kada god je ovim Općim uvjetima ili Ugovorom predviđeno da Putnik daje bilo koju izjavu, jamstvo, odricanje ili preuzima neku obvezu, smatra se da Putnik isto čini u svoje ime i u ime Klijenta.

Klijent je dužan dati sve potrebne osobne podatke svakog od Putnika i pravodobno dostaviti Agenciji svu dokumentaciju potrebnu za organizaciju i realizaciju putovanja. Agencija ima pravo zatražiti i zadržati preslike dokumenata ukoliko je to potrebno za realizaciju putovanja. Ako Klijent ne dostavi tražene podatke i preslike dokumenata u roku i na način kako je Agencija zatražila, smatra se da je odustao od rezervacije odnosno raskinuo Ugovor te je Klijent dužan platiti Agenciji ugovoreni iznos naknade za raskid Ugovora. Klijent je odgovoran za svu štetu koja za Klijenta ili bilo kojeg Putnika ili Agenciju nastane zbog davanja netočnih i/ili nepotpunih podataka i/ili dokumenata.

Ako je neki od Putnika maloljetnik koji putuje bez pratnje roditelja ili druge ovlaštene osobe u okviru paket-aranžmana koji uključuje smještaj, Klijent je dužan pravovremeno dostaviti Agenciji sve izjave o suglasnosti zakonskih zastupnika svakog maloljetnog Putnika koje Agencija zatraži u skladu s Ugovorom i primjenjivim propisima (uključujući i suglasnosti za obradu osobnih podataka maloljetnog Putnika).

Klijent je dužan pribaviti svaku putovnicu, vizu, zdravstvenu iskaznicu ili drugu putnu dokumentaciju potrebnu za putovanje i boravak u inozemstvu za sve Putnike te osigurati da je navedena dokumentacija u svakom trenutku u cijelosti potpuna i valjana. Klijent je isključivo odgovoran ako bilo koji Putnik ne bude u mogućnosti ostvariti putovanje zbog neposjedovanja valjanih putnih isprava ili ako mu zahtjev za ishođenjem vize bude odbijen. U slučaju krađe ili gubitka putnih isprava za vrijeme putovanja, Putnik će sam snositi troškove pribavljanja novih isprava, kao i ostale troškove koji iz toga mogu proizaći. Klijent i svi Putnici koji nisu državljani Hrvatske i nemaju hrvatske putne dokumente trebaju se prije sklapanja Ugovora osobno informirati o zemlji u koju putuju i uvjetima koje je potrebno ispuniti za putovanje u tu zemlju s obzirom na različitost propisa koji vrijede za državljane pojedinih zemalja. Osnovne informacije o viznom režimu primjenjivom u Republici Hrvatskoj dostupne su na službenim mrežnim stranicama hrvatskog Ministarstva vanjskih i europskih poslova http://www.mvep.hr/en/consular-information/visas/visa-requirements-overview/, a eventualna pitanja vezano za navedeno Putnik može uputiti navedenom Ministarstvu na e-mail adresu This email address is being protected from spambots. You need JavaScript enabled to view it.. Radi izbjegavanja dvojbe, Agencija ne snosi nikakvu odgovornost za točnost i potpunost navedenih informacija i odgovora Ministarstva.

Klijent je odgovoran za provjeru i potvrdu datuma i vremena polaska/dolaska letova prikazanih na zrakoplovnim kartama i za pravovremenu prijavu (check-in) u zračnu luku, te Agencija ne snosi nikakvu odgovornost za eventualno propuštene letove zbog zakašnjele prijave (check-in) u zračnu luku.

Svi Putnici dužni su poštivati druge ljude u zemlji koju posjećuju, te se u svakom trenutku pridržavati svih primjenjivih propisa (uključujući i devizne i carinske propise). Putnik je dužan pridržavati se pravila smještajnih jedinica u pogledu vremena početka korištenja i napuštanja soba, apartmana, kabina i sl. Ako Putnik na bilo koji način narušava sigurnost, mir ili udobnost drugih Putnika ili trećih osoba ili ugrožava i/ili otežava redovno odvijanje putovanja u skladu s Programom putovanja, Agencija osim prava na naknadu štete ima pravo prekinuti putovanje za tog Putnika i nastaviti provedbu putovanja u skladu s Programom putovanja bez njega. Ako je u tom slučaju Putnik maloljetna osoba, Klijent je dužan osigurati povratak Putnika kući o vlastitom trošku.

Putnik je dužan pridržavati se svih razumnih naputaka predstavnika Agencije i u dobroj vjeri surađivati s predstavnikom Agencije. U slučaju bilo kakvog nezadovoljstva, Putnik je dužan smireno i u dobroj vjeri surađivati s predstavnikom Agencije i na licu mjesta nastojati razriješiti predmet nezadovoljstva, bez javnog izražavanja nezadovoljstva, utjecaja na druge Putnike i treće osobe, te bilo kakvih radnji koje bi mogle narušiti ugled Agencije.

Klijent je dužan obavijestiti Agenciju prije sklapanja Ugovora o svim činjenicama u pogledu zdravlja, navika i sl. svakog od Putnika koje bi mogle ugroziti odvijanje putovanja (uključujući ako Putnik iz zdravstvenih i drugih razloga traži određenu vrstu hrane, boluje od kronične bolesti, alergija i sl.). Ako su u Programu putovanja navedena posebna pravila za putovanje (poput primjerice obveznog cijepljenja i nabavke odgovarajućih dokumenata), Putnik je dužan ispuniti navedene zahtjeve.

Klijent izričito izjavljuje da će se Klijent i svi Putnici suzdržati od bilo kakvih javnih izjava ili objava na Internetu ili bilo kojem drugom mediju koje bi u cijelosti ili dijelom bile neistinite, nepotpune ili zavaravajuće te mogle naštetiti ugledu i interesima Agencije. Takvo postupanje za posljedicu ima Klijentovu obvezu da naknadi sve štete koju Agencija može pretrpjeti (uključujući i svu izmaklu dobit i povredu prava osobnosti), a može imati i obilježja kaznenog djela sukladno primjenjivim propisima.

Putnik je dužan čuvati privatnost svih ostalih Putnika i trećih osoba, te ne smije ni na koji način evidentirati, fotografirati ili čuvati njihove osobne podatke u suprotnosti s GDPR-om. Putnik izričito izjavljuje da je upoznat s činjenicom da su kazne za povredu GDPR-a značajne, te odgovara Agenciji za cjelokupnu visinu eventualne kazne i ostalu štetu koju bi Agencija mogla pretrpjeti uslijed povrede GDPR-a od strane Putnika.

U slučaju povrede obveza iz Ugovora i primjenjivih propisa, Klijent i Putnik će odgovarati za svaku štetu koju pretrpi bilo koji Putnik, Agencija, bilo koji pružatelj usluga uključen u paket-aranžman ili bilo koja treća osoba, te će obeštetiti Agenciju od svih zahtjeva po toj osnovi. Klijent je solidarno odgovoran s Putnikom za obveze Putnika iz prethodne rečenice. U slučaju povrede obveze iz prethodne rečenice, koja za posljedicu ima prekid putovanja, Agencija nema nikakvu daljnju odgovornost prema Klijentu/Putniku (uključujući i organizaciju povratka u zemlju domicila), te Agencija ne vrši povrat uplaćenih sredstava i ne snosi nikakve troškove niti štetu nastalu prekidom putovanja.

PRIGOVORI
Klijent i/ili Putnik je dužan bez nepotrebnog odgađanja i vodeći računa o okolnostima, obavijestiti Agenciju putem kontaktne točke Agencije navedene u Ugovoru o svakoj nesukladnosti koju utvrdi tijekom ispunjenja usluge putovanja obuhvaćene Ugovorom. Agencija će na zahtjev Klijenta odnosno Putnika ispraviti tu nesukladnost, osim ako to nije moguće ili ako bi otklanjanje nesukladnosti prouzročilo nesrazmjerne troškove uzimajući u obzir razmjer nesukladnosti i vrijednost usluga putovanja na koje nesukladnost utječe. Ako Agencija ne ispravi nesukladnost iz razloga koji su navedeni u prethodnoj rečenici, Klijent ima pravo na sniženje cijene, te pored toga i na naknadu štete osim ako je ista posljedica Razloga za koje Agencija ne odgovara. Ako Agencija po prigovoru Klijenta odnosno Putnika ukloni uočenu nesukladnost, te Putnik takvu uslugu prihvati i iskoristi, Putnik se odriče bilo kakvih daljnjih prigovora, prava i potraživanja po toj osnovi.

Ako nesukladnost nije riješena sukladno prethodnom odjeljku ovih Općih uvjeta, Klijent može podnijeti Agenciji pisani prigovor putem e-maila na adresu This email address is being protected from spambots. You need JavaScript enabled to view it., putem telefaksa ili preporučenom poštom na adresu Agencije navedenu u ovim Općim uvjetima. Navedeni prigovor Klijent je dužan podnijeti Agenciji najkasnije 8 dana nakon završetka putovanja te je istome dužan priložiti dokaze da je Klijent/Putnik prethodno postupio u skladu s prethodnim odjeljkom ovih Općih uvjeta. Ako Klijent nije podnio navedeni prigovor Agenciji u roku iz prethodne rečenice ili uz prigovor nije dostavio dokaze da je Klijent/Putnik postupio u skladu s prethodnim odjeljkom ovih Općih uvjeta, smatra se da se Klijent odrekao svih prava i potraživanja Klijenta i bilo kojeg Putnika po toj osnovi, te su se u tom slučaju Klijent i svi Putnici dužni trajno suzdržati od bilo kakvih negativnih recenzija i drugih radnji koje bi mogle biti štetne za interese i ugled Agencije. Agencija je dužna u roku od 15 dana od primitka prigovora Klijenta dostaviti pisani odgovor - rješenje o prigovoru. Do isteka navedenog roka, Klijent neće pokretati bilo kakav sudski, arbitražni, upravni ili bilo kakav drugi postupak, niti davati bilo kakve izjave ni objave u medijima ili putem interneta. Maksimalni iznos sniženja cijene po Klijentovom prigovoru je iznos spornog dijela usluga, te ne može uključivati već upotrijebljene usluge ili cijeli iznos cijene paket aranžmana.

PUTNO OSIGURANJE
Preporučamo i tražimo pri sklapanju Ugovora/Vouchera s Klijentom da Klijent i svi suputnici Klijenta imaju odgovarajuće i dostatno putno osiguranje za pokriće Putovanja jer ni Adriatic Luxury Escapes d.o.o. niti naši dobavljači ne mogu biti odgovorni za bilo kakvu obvezu, troškove ili gubitke koji su nastali zbog neodgovarajućeg osiguranja. Preporučujemo da u trenutku rezervacije putovanja Klijent pribavi sveobuhvatnu policu putnog osiguranja.

IZMJENE PROGRAMA PUTOVANJA I OTKAZ PUTOVANJA OD STRANE AGENCIJE
Agencija nakon sklapanja Ugovora, a prije početka paket-aranžmana može dostavom pisane obavijesti Klijentu jednostrano izmijeniti uvjete Ugovora pod uvjetom da je takva izmjena beznačajna, to jest da značajno ne mijenja niti jedno od glavnih obilježja usluga putovanja, ne umanjuje razinu kvalitete ili vrijednosti paket-aranžmana, niti uzrokuje značajnije neugodnosti ili dodatne troškove za Putnika. Ako je Agencija nakon sklapanja Ugovora, a prije početka paket-aranžmana prisiljena znatno izmijeniti bilo koje od glavnih obilježja usluga putovanja ili ne može ispuniti ugovorene posebne zahtjeve Putnika navedene u Ugovoru, dužna je bez odgode o tome obavijestiti Klijenta pisanim putem. Navedena obavijest uključivat će opis predloženih izmjena Ugovora i eventualnog zamjenskog paket-aranžmana koji Agencija može ponuditi Klijentu. Osim ako je drugačije navedeno u takvoj pisanoj obavijesti Agencije, ako u roku od 3 dana od primitka navedene obavijesti Agencije Klijent pisanim putem ne obavijesti Agenciju da prihvaća izmijenjeni Ugovor ili ponuđeni zamjenski paket-aranžman, Ugovor se smatra raskinutim, te će Agencija bez odgode, a najkasnije u roku od 14 dana, vratiti Klijentu/Putnicima do tada uplaćeni dio cijene. Ako izmjene Ugovora imaju za posljedicu paket-aranžman niže kvalitete ili cijene, Klijent ima pravo na primjereno sniženje cijene.

Agencija može raskinuti Ugovor i Klijentu/Putnicima u cijelosti vratiti sva plaćanja primljena za paket-aranžman, bez obveze naknade štete i bilo kakvih drugih plaćanja Klijentu ni bilo kojem od Putnika, ako Agenciju u izvršenju Ugovora spriječe izvanredne okolnosti koje se nisu mogle izbjeći pod uvjetom da Agencija o raskidu Ugovora obavijesti Klijenta bez nepotrebnog odgađanja prije početka paket-aranžmana.

OSIGURANJE JAMČEVINE ZA SLUČAJ NESOLVENTNOSTI I OSIGURANJE OD ODGOVORNOSTI ZA ŠTETU
Sukladno ZPUT-u, Agencija je s osiguravajućim društvom EUROHERC osiguranje d.d. ZAGREB|OIB 22694857747|Podružnica DUBROVNIK, Dr. Ante Starčevića, temeljem Ugovora o osiguranju od dana 11.11.2024 ugovorila osiguranje jamčevine za slučaj nesolventnosti koje omogućava Putniku neposredno ostvarivanje prava iz jamčevine od osiguravajućeg društva pod brojem police 804474853. U slučaju nastanka osiguranog slučaja Klijent/Putnik treba na najbrži način kontaktirati navedenog osiguravatelja EUROHERC osiguranje d.d. ZAGREB|OIB 22694857747|Podružnica DUBROVNIK, Dr. Ante Starčevića na Tel: +385 (0)20 352 720, ili putem e-mail: This email address is being protected from spambots. Sukladno ZPUT-u, Agencija je s osiguravajućim društvom EUROHERC osiguranje d.d. ZAGREB|OIB 22694857747|Podružnica DUBROVNIK, Dr. Ante Starčevića, temeljem Ugovora o osiguranju od dana 11.11.2024 ugovorila osiguranje od odgovornosti za štetu koju Agencija prouzroči putniku neispunjenjem, djelomičnim ispunjenjem ili neurednim ispunjenjem obveza iz Ugovora pod brojem police 804474852. U slučaju nastanka osiguranog slučaja Klijent/Putnik treba na najbrži način kontaktirati navedenog EUROHERC osiguranje d.d. ZAGREB|OIB 22694857747|Podružnica DUBROVNIK, Dr. Ante Starčevića na Tel: +385 (0)20 352 720, ili putem e-mail: This email address is being protected from spambots. Ovo vrijedi kao potvrda o osiguranju za slučaj stečaja ili platne nemogućnosti Agencije i osiguranju od odgovornosti za štetu.

ZAŠTITA OSOBNIH PODATAKA
Klijent i Putnici svoje osobne podatke daju Agenciji dobrovoljno. Osobni podaci Klijenta i Putnika potrebni su Agenciji u procesu realizacije ugovorenog paket-aranžmana te će se koristiti za daljnju komunikaciju, ugovaranje i izvršenje usluga obuhvaćenih paket-aranžmanom. Agencija će osobne podatke Klijenta i Putnika obrađivati, koristiti i čuvati u skladu s primjenjivim propisima, uključujući GDPR, te ih neće iznijeti iz zemlje ili dati trećoj osobi, osim dobavljačima i suradnicima koji sudjeluju u realizaciji ugovorenog paket-aranžmana. Osobni podaci Klijenta i Putnika čuvat će se u bazi podataka, sukladno odluci Agencije o načinu prikupljanja, obrade i čuvanja osobnih podataka. Pod uvjetom da je Klijent/Putnik za to dao svoju privolu, Agencija može upotrebljavati osobne podatke Klijenta/Putnika u marketinške svrhe (npr. slanje obavijesti, akcija, promocija, newslettera). Klijent i svaki od Putnika mogu u bilo kojem trenutku uskratiti suglasnost za korištenje osobnih podataka u marketinške svrhe slanjem e-mail zahtjeva Agenciji na This email address is being protected from spambots. You need JavaScript enabled to view it.. Pravila o zaštiti privatnosti Agencije dostupna su na mrežnim stranicama Agencije: https://www.adriaticluxuryescapes.com/privacypolicy. Sklapanjem Ugovora Klijent potvrđuje da je pročitao navedena pravila, da je s istima upoznao sve Putnike, te da Klijent i Putnici u cijelosti razumiju i prihvaćaju navedena pravila.

ZAVRŠNE ODREDBE
Smatrat će se da je dostava obavijesti između Ugovornih strana sukladno Ugovoru valjano izvršena pisanim putem ako je poslana e-mailom na posljednju e-mail adresu o kojoj je jedna Ugovorna strana obavijestila drugu pisanim putem. Klijent je isključivo odgovoran za točnost e-mail adrese za slanje obavijesti o kojoj je obavijestio Agenciju, te je dužan bez odgode pisanim putem obavijestiti Agenciju o bilo kakvoj promjeni podataka za slanje obavijesti.

Ugovorne strane će sve eventualne sporove vezano za Ugovor (uključujući njegovo izvršavanje i prestanak) pokušati riješiti sporazumno, a ako to nije moguće bit će nadležan sud u Dubrovniku, Hrvatska. Mjerodavno pravo je pravo Republike Hrvatske (isključujući njegove odredbe o sukobu zakona koje bi upućivale na primjenu stranog prava). Sukladno ZPUT-u, Klijent može podnijeti prijedlog za rješavanje spora pred tijelom s liste notificiranih tijela za alternativno rješavanje potrošačkih sporova, sukladno odredbama posebnog zakona kojim se uređuje alternativno rješavanje potrošačkih sporova. Podaci o trenutno notificiranim tijelima za alternativno rješavanje potrošačkih sporova dostupni su na mrežnim stranicama Ministarstva gospodarstva, poduzetništva i obrta Republike Hrvatske: http://potrosac.mingo.hr/hr/potrosac/clanak.php?id=12645. Za usluge kupljene putem interneta, platforma za mrežno rješavanje potrošačkih sporova dostupna je na poveznici: https://ec.europa.eu/consumers/odr/main/indeks.cfm?event=main.adr.show.

Ako bilo koja odredba Ugovora ili ovih Općih uvjeta jest ili postane ništetna, nevaljana ili neizvršiva, ili ako Ugovor sadrži nenamjeravanu ugovornu prazninu, to neće utjecati na valjanost ili izvršivost ostatka Ugovora. Bilo koja takva ništetna, nevaljana ili neizvršiva odredba će se smatrati zamijenjenom, a praznina upotpunjenom, odgovarajućom odredbom koja je sukladno gospodarskoj svrsi i cilju te odredbe i/ili Ugovora, u mjeri u kojoj je to zakonski dopušteno, najbliža izvornoj namjeri Ugovornih strana.

Ovi Opći uvjeti isključuju sve ranije izdane opće uvjete poslovanja Agencije o putovanjima u paket-aranžmanu, te stupaju na snagu s datumom objavljivanja na mrežnim stranicama Agencije, odnosno dana 11.11.2024 godine. Agencija zadržava pravo izmjene ovih Općih uvjeta u bilo kojem trenutku objavljivanjem izmijenjenog teksta Općih uvjeta na mrežnim stranicama Agencije, koji stupa na snagu s danom objave.
